Terms and Conditions are applicable to all services offered by Go Executive Transfers Limited (goexecutivetransfers.com).
1 Definitions and Interpretations
This document includes definitions and their interpretation, which can be referred to throughout the agreement, such as
- These Conditions: refers to the standard terms and conditions of sale outlined in this document, and, unless stated otherwise, encompasses any special terms and conditions mutually agreed upon in writing between the Passenger and the Provider.
- The Passenger:denotes the individual who accepts a quotation or offer presented by the Provider for the sale of Services or whose order for the Services is acknowledged by the Provider.
- The Provider:signifies Go Executive Transfers Limited.
- The Contract:signifies the agreement for the provision of airport transfer services as per these Conditions.
- The Service:designates the transportation service to or from airports (including any instalment of the service or multiple services) that the Provider is committed to delivering in accordance with these Conditions.
In these Conditions, any reference to a statute or its provision is to be understood as pertaining to that statute or provision as amended, re-enacted, or extended during the relevant period.
The headings in these Conditions are provided for convenience purposes only and do not impact their interpretation.
2 Conditions
2.1 The Provider will sell, and the Passenger will buy the Service based on an accepted quotation or offer from the Provider or an accepted reservation from the Passenger. This transaction is subject, in either scenario, to these Conditions. These Conditions shall govern the Contract, excluding any other terms and conditions that may accompany the acceptance of a quotation or reservation by the Passenger.
2.2 A contract will be established only upon the Provider's acceptance of the reservation, and the subsequent conditions are considered integral to the contract. The passenger acknowledges and agrees to these terms and conditions by making a reservation or booking through various channels, including but not limited to the provider's website (http://www.goexecutivetransfers.com), telephone, live chat or any representative agent.
2.3 The Contract will adhere to these conditions. The provider retains the authority to modify these terms and conditions at its sole discretion, without prior notice. Any updated terms and conditions will be published on the provider's website and will become effective one hour after posting.
2.4 The provider will not consider any reservation from the passenger as accepted unless and until it is confirmed in writing through email, telephone, live chat or by an authorized representative of the provider.
2.5 The service specifications will align with the details outlined in the provider's sales documentation, unless explicitly altered in the passenger's reservation (if accepted by the provider). The service will strictly adhere to the specifications stated in the provider's price list. Reservations deviating from these specifications will be adjusted accordingly. Any illustrations, photographs, or descriptions in the website, brochures, price lists, or other documents issued by the provider are intended for guidance only, and their contents are not binding on the provider.
2.6 The provider retains the right to implement changes in the service specifications necessary to comply with applicable safety or other statutory or regulatory requirements. Additionally, if the services are to be provided based on the provider's specifications, changes may be made that do not significantly impact their performance.
2.7 Subcontracting companies are not permitted to make any representations or claims regarding the service unless officially confirmed in writing by the Provider through email, telephone, or other means. By entering the Contract, the Passenger acknowledges that it does not rely on, and waives any claims for a breach of, any such representations that have not been confirmed in writing.
2.8 Any changes to these Conditions will not be legally binding unless they are mutually agreed upon in writing, be it through email, telephone, or any other means, between the authorized representatives of the passenger and the provider.
2.9 Sales literature, price lists, and other documents provided by the provider regarding the service are subject to change without prior notice and do not constitute offers that can be accepted. Once a reservation is placed by the passenger, it cannot be withdrawn, cancelled, or altered until accepted by the provider. A contract for the offer of service will only be binding on the provider if the provider has issued a quotation expressly stated as an offer of service or has accepted a reservation placed by the passenger, whichever occurs first:
2.9.1 the Providers written acceptance.
2.9.2 delivery of the service.
2.10 The Provider holds the right to correct any typographical, clerical, or accidental errors or omissions in sales literature, quotations, price lists, acceptance of offers, invoices, or any other documents or information without incurring any liability.
2.11 The cost of the service will be the price stated in the Provider's current published price list on the date of accepting the passenger's reservation. Alternatively, a different price may be agreed upon in writing between the provider and the passenger.
2.12 If the provider has provided a price for the service that deviates from the published price list, the quoted price will remain valid for a period of 24 hours or any other duration specified by the Provider.
2.13 The Provider retains the right to notify the Passenger, at any time before delivery, of an increased price for the service. This adjustment aims to reflect any rise in the provider's costs resulting from factors beyond their control. These factors may include, but are not limited to, foreign exchange fluctuations, currency regulations, alterations of duties, changes in delivery dates, quantities, or specifications requested by the Passenger, or any delay caused by the Passenger's instructions or failure to provide adequate information or instructions.
2.14 The Provider maintains the right to engage the services of contractors or subcontractors (referred to as third parties) to deliver services to Passengers. The Provider, at its discretion, will furnish details, including names and addresses, of any such third parties upon a reasonable request.
2.15 Reservations made for service on the specific dates of December 24th, 25th, 26th, 31st, and January 1st will incur an additional surcharge of 50%, automatically included in the quote.
2.16 A maximum time of 1 hour will be allocated for address collections and 3 hours for airport collections. If there is no contact with passengers within this timeframe, the reservation will be considered a no-show and will be subject to clauses 3.2 and 4.5.
2.17 Any payments made to the Provider for the provision of service, excluding cash in pounds sterling, on confirmed reservations made directly or indirectly with the provider, will be subject to a charge (booking fee) of 5% of the total quoted price, in addition to any cash payment or discounted price.
3 Terms of Carriage
3.1 Go Executive Transfers Limited, herein referred to as the Provider, bases its prices on the assumption that Passengers are prepared to travel at the booked time. Passengers are required to schedule their airport transfer in alignment with the check-in times and guidelines specified by their respective airline.
3.2 For all meets, excluding "airport pick-ups," the first 15 minutes of waiting time are complimentary; beyond that, a charge of 35p per minute will apply for the entire waiting period. Regarding airport pick- ups, there is an initial 1 hour waiting time from the time the flight lands, after which a charge of 50p per minute will apply for the entire waiting period. It's important to note that there is no charge for flight delays, as the driver is dispatched accordingly.
3.3 The quoted fares are fixed rates. Any diversions, additional set-downs, or pickups by passengers will result in a minimum charge of £20.00 per diversion. Fares quoted without a booking will remain valid for 24 hours. Go Executive Transfers Limited reserves the right to alter prices without prior notification; however, any quote or booking confirmed by Go Executive Transfers Limited will remain binding.
3.4 Go Executive Transfers Limited and its contracted or sub-contracted drivers do not accept responsibility for the loss or damage to luggage. Passengers are accountable for ensuring the loading/unloading of their luggage if accompanying it on the journey. Go Executive Transfers Limited and its contracted or sub-contracted drivers reserve the right to refuse any passenger or make the journey due to excess luggage that would compromise the safety of the vehicle while in motion.
3.5 Passengers book vehicles based on their preferences. Saloon and Estate cars can accommodate a maximum of 4 passengers and luggage. For larger groups of passengers or additional luggage space, specialized vehicles are available and should be booked accordingly. Detailed information on luggage limitations, vehicle types, and their suitability can be viewed in the Vehicles section.
3.6 In its vehicles, Go Executive Transfers Limited strictly prohibits the transportation of the following items:
· Explosives, firearms, flammables, tear gas, mace, pepper spray
- Perishables
- Fragile, breakable, or temperature-sensitive items
· Pets, insects, animals (excluding registered Guide Dogs for the visually impaired)
- Cash
- Hazardous waste
- Pressurized containers
- Securities and negotiable papers
- Human remains
- Alcoholic beverages, or anything containing alcohol
- Illegal narcotics/drugs
· Go Executive Transfers Limited reserves the right to disallow additional goods at any time
3.6.1 In cases where unaccompanied luggage is transported, you agree to defend, indemnify, and hold Go Executive Transfers Limited, its owners, employees, clients, agents, and drivers harmless from all claims, demands, causes of actions, damages, liabilities, costs, and expenses, including attorneys' fees. This includes any issues arising from or related to your acts or omissions in connection with your use of the Service and omissions in relation to clause 3.6 in its entirety.
3.6.2 When transporting unaccompanied luggage, Go Executive Transfers Limited will make every effort to deliver the luggage to the specified destination as booked by the passenger. In cases where the driver cannot obtain a signature for the receipt of luggage upon delivery, the driver is authorized to return the luggage to our head office. Additional storage and delivery costs may be incurred in such instances.
4 Cancellation and Refund Policy
4.1 No reservation accepted by the Provider may be cancelled by the Passenger except with the written agreement, whether by email, telephone, live chat or any other means of the Provider. Any cancellation must be on terms suitable for the purpose for which the reservation was made, as outlined in clause 3.5 and subject to clause 4.5. Vehicles cancelled by passengers after acceptance of reservation by the provider will incur in one of following.
4.2 You are eligible for a full refund if you cancel your booking 12 hours prior to the scheduled service.
4.3 If you choose to cancel your booking 12 hours prior to the scheduled service, a cancellation charge of 25% of quoted price will be applied.
4.4 If a cancellation occurs 12 hours prior to the scheduled service, a cancellation charge of 50% of the quoted price will be applied.
4.5 In case of cancellation 3 hours prior to the scheduled service, a cancellation charge of 100% of quoted price will be applied.
Please note that the time frame for cancellation is calculated based on the scheduled service time. Refunds will be processed according to the original payment method. 5 General Applications
5.1 The Provider shall not be held responsible to the Passenger or considered in violation of the Contract for any delay in delivery or performance, or any failure to perform its obligations related to the Service, if the delay or failure results from any cause beyond the Provider's reasonable control. Without limiting the general applicability of this provision, the following shall be considered as causes beyond the Provider's reasonable control, whether directly or indirectly:
5.1.1 Acts of God, explosion, flood, tempest, fire, or accident.
5.1.2 War or the threat of war, sabotage, insurrection, civil disturbance, or requisition.
5.1.3 Acts, restrictions, regulations, byelaws, prohibitions, or measures of any kind on the part of any governmental, parliamentary, or local authority.
5.1.4 Traffic accidents, traffic hold-ups, traffic congestion.
5.1.5 Strikes, lockouts, or other industrial actions or trade disputes, whether involving employees of the Provider or of a third party.
5.1.6 Flight delays or cancellations.
5.1.7 Power failure or breakdown in machinery, including computer systems.
5.2 Except as expressly provided in these Conditions, all warranties, conditions, or other terms implied by statute or common law are excluded to the fullest extent permitted by law.
5.3 The Provider shall not be liable to the passenger for any direct or consequential loss or damage sustained by the Passenger, including loss of profit or indirect or special loss, costs, expenses, or other claims for consequential compensation arising out of or in connection with the supply of the services. This includes situations caused by the negligence of the Provider, its servants, or agents.
5.4 If clause 4.2 applies, then the Provider is entitled to cancel the Contract or suspend further deliveries under the Contract without any liability to the Passenger. If the Services have been delivered but not paid for, the price becomes immediately due and payable.
5.5 The Passenger undertakes to the Provider:
5.5.1 To regard as confidential the Contract and all information obtained relating to the business and/or products of the Provider, not using or disclosing such information to any third party without the Provider's prior written consent. This does not apply to information in the public domain other than due to the Passenger's default.
5.5.2 To use all reasonable endeavours to ensure compliance with this condition by its employees, servants, and agents. This condition survives the termination of the contract.
Miscellaneous
6.1 No waiver by the Provider of any breach of the Contract by the Passenger shall be deemed as a waiver of any subsequent breach of the same or any other provision.
6.2 If any provision of these Conditions is deemed invalid or unenforceable in whole or in part by any competent authority, the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected.
6.3 The Contract shall be governed by the laws of England & Wales.
